Well yeah, after i replied to them bout takin the song out of myspace they told me to take it out of SC too where i got like 500 downloads :( shyt.. but yeah.. now i have to pay to use it? WTF? shyt.. its funny though cuz hella ppl let me comments n messaged me on mysapce saying "where the hells your song? i loved that song.. where did u put it??" right after i took the song out.. ahhh lol well this is wut he sed :(

Music Sampling

The court’s analysis is somewhat complex but concludes that no sampling can be made without a license or permission.11 The reason is not because of the copyright to the music composition in the sample, but because of the copyright to the sound recording. The court interprets the copyright statute, 17 USC Section 114, as prohibiting the copying of the whole or any part of a sound recording. The new ruling reasons that you should either pay for a license to sample a song with the original sound recording, or go into the studio yourself and recreate the sample with your own sound recording.

For many hip hop and rap musicians, the point of sampling a song is precisely to copy the sound recording of a well known song to give their song a certain feel or emphasis. The intent is to link their song in this manner to the earlier song in the listener’s mind. Most would not consider trying to reproduce the sound independently because it wouldn’t have the same feel. The Bridgeport Music opinion now clarifies that samples of original recordings must be licensed.

Demos are done all the time with unliscenced beats, they jus get given out as samples but not sold.

Dont let em play you. I mean they would never be able to find out who you are off those sites anyway unless you puttin up your Address on the site.

i seriously wouldn't worry about it...one if you haven't dropped personal details I.E address or real name...then they can't mail you a legal letter under your rap name to an address that they don't have...secondly...they can't actually get any money off this stunt they're pulling because they have to PROVE that you are trying to make a profit out of their track which you said you haven't so really all the courts can do is slap ya wrist and say not to do it again coz you didn't have any legal knowledge of the music industries sampling laws...trust it's nothing to worry about send them a fuck you type message back and laugh...

whats to consult?- Have you made a dime off the song? do you intend to?-- as long as your answer is no to both of those questions, they can't do jack shit... They assume you are marketing this song, that your performing it, selling it on a cd- they want a chunk of the cash they assume your making. If your not making money, don't worry about it.

I don't see how you can get sued for lost income, if your not making a dime off it in the first place.- He's not taking money from anyones pockets by making a song in an attempt to elevate. I could see all that shit happening if he made a little mixtape and sold a copy, but its soundclick, thats like getting sued by dre for spittin over a dre beat in your car.

granted, Im sure you know more about this shit than I do, since you actually have a reason to know the legalities, I just don't see the logic in getting sued over a track thats not generating any income.

nah, the use of an artists voice isn't loss of wages (which would be that someone took money that they otherwise would have made without the interferience), it's loss of income if you don't pay it. Like...ok, I got it, it's liek tihs: This company makes it's money by leasing out copies of their artists' voice. By you not paying them for the thing they do every day causes them to lose income. It's like working for an employer that dosen't pay you, in effect. Just in this case, he dosen't know he's acting as an employer and refuses to pay em. Putting them tracks back up is def gonna get the dogs sicked on him. These guys don't play around man, lol. The fact that they warned him makes any hope for an "I didn't know" legal defence completely disapear. Especialyl seeing that "ignorance isn't a legal defense". Personally, in his shoes, I'd a had a lawyer on the horn this morning.
