can someone please help me figure out why I can't use a custom avy.

like when I go to edit avatar in the User CP, the custom avatar tab isn't even avaliable.

You need to get your account upgraded to Registered Voter status to change your avatar.. which means you need 250 posts and 5 wins or 500 posts.
