James Van Iveren claims he was simply trying to save a woman from being raped, following being charged with criminal trespass, disorderly conduct, and criminal damage to property. He was released on a $5,000 bond and ordered to appear in court on March 9. The charges resulted from him kicking in the door following what he believed to be screams of terror, but were in fact screams from a porno movie.

On February 12th, after Van Iveren heard a female scream in neighbor Bret Stieghorst's upstairs apartment, he grabbed a 39-inch cavalry sword, and ran upstairs to confront his neighbor. Van Iveren had intended to knock on the door, but instead kicked the door in and forced his way inside.

He then gazed around Stieghorst's apartment and demanded to know where the woman was. He forced his neighbor to open a closet so he could search there also.

However, Stieghorst said there was no one in the apartment and that Van Iveren had heard a pornographic video Stieghorst had been watching.

"Now I feel stupid," said Van Iveren, according to AP. "This really is nothing, nothing but a mistake."

Van Iveren, who lives with his mother, said he didn't call the police because he doesn't have a phone. However, according to Milawauke Journal Sentinel, Waukesha County Assistant District Attorney Kevin Osborne has a problem with Van Iveren's story, saying, "It's reported that he pounded on the door and kicked it in before the man had a chance to open it. That doesn't appear to have been a reasonable reaction to me." Also, Osborne says that the sounds on the Spanish pornographic DVD, "Casa de Culo," were sounds of consensual sex, not rape.

The charges filed against Van Iveren stem from his unreasonable actions even though Stieghorst believes his neighbor actually thought he was doing the right thing. He further stated that all he cared about was the damage to his property.

Authorities have seized the sword, which Van Heren claims is a family heirloom. If convicted, Van Heren could serve up to 33 months in jail.
