Music Industry Sues...
 
the music industry is now suing random people who download songs off of Kazaa and other programs like that for big money depending on the number of songs you download. the FBI is gathering information from comcast customers (who keep the same IP number, not a different one every time the use the net like 56k users) and also gathering info on dial up users.
deleting ur songs does nothing, the FBI is now gettin subpoenas (makin comcast show them who was on the net at certain time, wut u were doin blah blah blah...) and suing random people.
if ur under 18, ur parents pay. if ur over u pay (duh)
this is gay i want free songs!
oh and firewalls do nothin dont bother to download one if u are threatened by this...


if you are a geek...
you can reroute ur computer thru another countrys phone lines and the US cant track what computer the songs are on.

they just going after those who hosting 1000's of files as an example. most got nuthin to fear cus the scale of shit is unmanagable n soon hackers will write programs for people to mask ip shit if it's necessary.

the real issue is how/when the recordin industry is going to evolve. services like Itunes is a step forward. but i don't see terminals in music stores where u could burn a disk without having to pay for:

Packaging, CD production, CD distribution, some of the marketing costs, some of the labor cost, etc. etc. that go into a physical prepackaged cd.

this ain't happened cus the record labels have longstandin relationships with all the companies who do the above and they are applying mad pressure to not have this happen.

the thing is the record companies complain bout artists not getting paid but the facts show record sales are still increasing and any margin they (record company) is loosin out on ain't from their (artists) pockets. you may notice most artists who speak up the most own their own record labels, dre, madonna, etc. the average artist wit a cd out makes the majority of their earnins through concerts.

The real question is whetha you would be willin to do without expensive video's and maybe pay 30-40% more for a concert ticket if the music was free?

Or would you rather pay $10 an album? or $5, or whatever it ends up being in tha future.

One kid got sued, 12 years old, and had to settle for $2000, what the fuck, I think Minors should get immunity on this, the fact is, kids are dumb. Everyone knows that no morales of this sort are instilled. My recommendation is going to www.apple.com and getting iTunes, you can download almost any song for 99¢ and it's 100% legal, the RIAA will never get you because they have a deal with them which makes it legite.

they are not targeting just people with thousands of song. one 70 year old man is getting sued for over a million dollars for having old releases that arent even on cd. this will not last long. the goverment will put a stop to the RIAA. they are breaking laws and violating our privacy.

btw... downloading a song is not against the law. sharing the song to let others download is against the law. they can only charge those who share files. i never shared my files anyway. also it is very easy to set up a proxy to cover your ip address. and the chances of u getting caught are slim to none. u can also use kazaa lite which will hide your ip address and its a 3rd party software company so they cant be subpoenad.

... and itunes is bullshit. 99¢ a song.... 20 tracks a cd... 1 cd with no art work and lower than cd quality = $20. plus u cant get all songs. dont fuckin sweat the bullshit people. the RIAA is trying to scare people into not downloading music. they have little authority and the court system is not letting them sue these people. theyre trying to sue kids for millions of dollars. the only ones paying are the stupid morons that settled out of court.

^^ Its bullshit my Uncle studied Law, they cant legally sue you for even that much... 1. Because There is nothing in their contract when you download it about being illegal and 2. They cant sue consumers they have to first sue the Compony

the law is that u can't distribute a copyrighted material without paying royalties to the owner of the copyright. so whether your providing it on your computer for people to take or handin out brunt cd's on a street corner for free they are both copyright infringment.

conerning Kazaa, it doesn't matter what's in their contract because they are neither the one uploading the music nor downloading the music. to say that kazaa is responcible is like saying the entire internet is responcible. kazaa is just a medium. if you rent a boat and go to columbia for drugs u can't complain after being arrested that the boat rental agancy didn't say it was illegal to transfer drugs usin their product.

This is why the law suits against kazaa have failed, while those against individuals are now succeeding.

HOWEVER.... i agree that the price of music is too high because the industry ain't takin advantage of digital distribution. Still, no matter how the music is distributed bands/record companies make money by:

1) selling cd's
2) performing at concerts
3) earning royalties from broadcasts (mtv/radio)

The money earned from these revenues is spent on:

1) Recording Studios, Sound Engineers, Studio Musicians, etc
2) Lawyers, Agents, Beauticians, PR people, etc.
3) Videos
4) CD Artwork Design, Packaging, Physical distribution of the CD to the store.

The money they might save by getting rid of #4 (packaging, production, distribution) does not make up for the loss of the revenues they and the record companies get from selling cd's. So either:

A) The record companies take a hit to their profit margins and bands end up charging more for concerts and broadcast royalties.
--> In this situation the reduced profits the record company makes would mean they would sign fewer bands and wouldn't risk putting as much money into alternative or unproven styles.

or

B) A new price for recorded music that is digitally distributed must be determined by the marketplace. Should it be $1 like Itunes, should it be $.50, should it be $.01 per songs?

What would you be willing to pay for a song in order for them to still be able to produce videos and record the albums using the highest quality studios, musicians, and producers?

Msn news said that there are 6 million people using kazaa, and they are going for the big dogs. But they still said it was slim that you be sued. Having thousands of files, does widen your chances, among other things. I use a ftp, that I haven't heard in the media yet, it's been quiet for years. i don't know what they hope to achieve, you can't control the internet. Plus, I remember on sesame street and in kidergarten, they TOLD US TO SHARE!

This is old news, i made a thread about it around two months ago, their only targetting people who download thousands of songs per day, so unless your doing that, your fine.
