Businessman Sues P. Diddy Over Similar Slogan

IP:

A Chicago businessman filed a patent infringement lawsuit Wednesday charging that the advertising slogan for Sean "P. Diddy" Combs' Sean John clothing line is too close to the motto for his own apparel company. Gregory Hilderbrand filed the suit in federal court in Chicago accusing the hip hop mogul, Sean John Clothing Inc. and Bad Boy Entertainment Inc. of patent infringement, unfair competition, defective trade practices and consumer fraud, according to the Associated Press.

Hilderbrand said he patented the phrase “It’s a lifestyle” in November 2002 and that Sean Johns’ new motto, “It’s not just a label…It’s a lifestyle,” is too similar. Hilderbrand seeks an immediate halt to Sean John’s use of the motto and seeks any revenues earned by the company while it used the phrase. If Hilderbrand has his way, his suit would put a halt to the new Sean John advertising campaign featuring reggaeton artist Daddy Yankee and rapper Fabolous. Hilderbrand also seeks suffering, punitive damages and attorney's fees. No court date has been set.
