we don't hold animals to the same moral code as humans...but, if we did, some animals could be indicted on charges of "cruelty"...
Not every animal kills for food or to protect itself...It's documented that some animals, particularly social animals, commit infanticide just to ensure their "DNA" gets passed along. THat's be like your ex girlfriend's new boyfriend killing your son so she could only have his child.
I agree some animals should be protected in some cases. But, jail time for kickin' a dog is a bit much, IMO.
