depending on where u live i can give u some legal advice.
first off when a child is born yalll both automatically have joint custody.
one has to actually apply to the family court for full custody....so if u havent done that than yall still have joint custody.
you will have a nasty custody battle in court.most times the court sides with the mother.
u have to prove she is an unfit mother.either way they are going to at least give her access to the kid.
first off,she should have been paying child support while u were raising ur kid.so thats a minus for her.
u wouldnt have to be paying any since u were raising the kid,duh.....
if u feel u can give your child the best home,than fight.prove that u got a job,stable home, n she is unstable cuz she up n left.if she does any drugs,etc,if she is out of work,if she doesnt have a stable place,they are going to look at all that.but she will get visitation.worst case scenario for her it might be supervised visits.
have lots of proof.witnesses,evidence if u want to discredit her.
but,the courts claim they do whats in the best interest of the child.
